Page 8. --- Victim Killed While Waiting on Highway for Bus Near Home --- EVIDENCE CONFLICTS ---- Brampton, Dec. 3. - Albert Crown, 23, Thamesford, found guilty yesterday by Judge Archibald Cochrane on a charge of dangerous driving was sentenced to three months in jail. Police testified he was driving a truck involved in a collision fatal to Miss Grace Cook, Cookeville, while she was waiting on the shoulder of the highway for a bus near her home on Nov. 14.
‘I can no longer grant suspended sentence in cases such as this,’ Judge Archibald Cochrane said. ‘While there would appear to be extenuating circumstances in this case, there have been an alarming number of traffic fatalities recently, and the public must be protected.’
Crown stated that he was forced to turn off the pavement by a car coming in the opposite direction, and said he did not see Miss Cook until she was four feet away. Following the impact he brought his cattle-filled truck to a stop by gradual brake applications so as not to injure his load, he added, traffic Officer Albert Dukes testified that Crown’s truck had stopped 375 feet from the point of impact.
Friend Testifies Miss Margaret Leonard, a friend of the deceased said she had seen the truck bearing down on Miss Cook, and told of trying to warn her. ‘But a moment later, Grace wasn’t there,’ she added.
The only other car she saw pass the truck was travelling in the same direction, Miss Leonard said. She said she did not remember seeing a car moving towards the truck.
Judge Cochrane said that in consideration of Miss Leonard’s evidence, he could not possibly accept Crown’s statement that a car was approaching the truck from the opposite direction.
Miss Cook, he said had a right to wait for a bus on the shoulder of the highway, although he strongly condemned the pedestrian practice of walking with one’s back to traffic. He said he could see no just cause why the truck should leave the road, and that Miss Cook, who was presumably three feet away from the pavement had reason to feel safe. It was up to the car driver to anticipate danger in such cases, he said.
‘May Have Slept’ ‘Accused may have fallen asleep at the wheel of his car,’ Judge Cochrane said. ‘After only five hours sleep, he then worked two hours before setting out on the long drive to Toronto. I am not sure employers have the right to expect this sort of thing. It is not fair to themselves, to the driver, or to the public.’
Chown’s load was described as ‘seven head of cattle and three pigs.’ Judge Cochrane said that, while the nature of the load did not appear to be responsible for this particular accident, he considered travelling over the highway with such a load was dangerous because it was difficult to make a reasonably fast stop without injuring the cattle.

Page 04. --- Thamesford, Sept. 29 (CP) - Robert Cook of Brantford is in Ingersol Jail tonight awaiting court appearance tomorrow on a charge of armed robbery arising from the daring daylight ‘toy-gun’ holdup of the Royal Bank of Canada branch in this small Ontario town. Cook, 26, was arrested yesterday shortly after three bank officials were herded into a vault by a man with a toy pistol. He escaped with $1,500 to $2,500, but most of it was recovered, bank officials said. There were no customers in the bank when the bandit entered, and Manager G. E. Hessenauer said he was ordered to put up his hands, with the warning, ‘this is a real stickup.’ The bandit backed the manager, Teller W. Horne and Ledgerkeeper R. G. Colbert into the vault and attempted vainly to lock them in. Horne handed him the money, and the bandit warned them not to leave the vault for five minutes while he made his getaway. In a few minutes the bank employees started after the bandit and he was captured by Horne and Allister Thom, a garage mechanic, less than two blocks from the bank. Police said he had gone to the 10th Concession from the bank, ostensibly to meet an accomplice in an automobile, and returned to Thamesford. He was running along the road toward London when Horne and Thom caught him. It was reported he scattered honey on the road and threw away a big, black toy pistol. Cook will be taken tomorrow to Woodstock for arraignment.
