# Department of Homeland Security Brands ThisCantBeHappening! a ‘Threat’ - This Can't Be Happening!

_ThisCantBeHappening!_ has just learned that our little news organization was listed, in an alert fired off to all 78 Fusion Centers by Kelly Wilson, Director of the Washington DC Fusion Center’s Regional Threat and Assessment Center, as a potential threat.

The stated role of the Fusion Centers, which were created (and lavishly funded) in the wake of 9-11, was to link federal, state and local law enforcement agencies in order to better detect and combat terrorists inside the US. So what about this threat posed by _ThisCantBeHappening!_ , though? Well, as Threat Assessment Director Wilson explains in her alert, the threat is that _TCBH!_ published an article suggesting that the Fusion Centers played a central role in orchestrating the attacks on Occupy Movement actions in cities all across the US.

As she states in her alert:

_“Although at this time these reference to fusion centers and Occupy seems_ [sic] _to be compartmentalized I wanted to make you aware of these references in case the national news media begins_ [sic] _speculating about fusion center involvement.”_

Wilson includes in her alert a headline and several key paragraphs from our Nov. 15, 2011 article (which was [later proven by us and others to be totally accurate][2]), as well as a link to [our entire article on those connections][3]. The selected quotation she chose read as follows:

We can see then that the exposing of a federal role in the brutal crushing of the peaceful and Constitutionally-protected Occupy Movement nationally, or even suggesting such a thing, in today’s America, is now considered to be a “threat” by the Department of Homeland Security and its Fusion Centers — both organizations that were specifically created not to monitor the media but to root out and “defend” the country from terrorism. The threat in our case is not that we are planning a bombing or some other kind of mayhem. Rather, what alarms the DHS and the “threat assessors” in the Fusion Centers is that _ThisCantBeHappening!’s_ investigative reporting might eventually lead to the news about the Fusion Centers’ role in crushing Occupy breaking out of the “compartmentalized” alternative media and into the national news media, which then might “begin speculating about fusion center involvement.” (It seems self-evident that if the Fusion Centers _had not been_ involved in orchestrating the Occupy crackdown, they _wouldn’t have been worried at all_ about some small alternative news outfit like ours, or even the mainstream media, “speculating” about such a role, ergo this fear of exposure amounts to a full admission that the DHS and its Fusion Centers stand guilty as charged.)

While this document and the mentality it represents are deeply disturbing, _ThisCantBeHappening!_ is at the same time proud to be recognized by the Washington intelligence nexus as posing that kind of threat to the emerging United States police state, of which the DHS and its Fusion Centers are a critical element.

Sadly though, although our article and the November 18 alert citing it sent out by Wilson ran in late 2011, it wasn’t until this month that the _New York Times_ [finally wrote about the Fusion Center role][6], using this and other documents obtained by the [Partnership for Civil Justice Fund (PCJ)][7], a Washington-based public interest legal organization focused on federal violations of the First and Fourth Amendments. And even then, the _Times_ buried its story of Fusion Center involvement in the national crackdown on Occupy in its inside pages, rather than playing it where it belonged on the front page. The paper also made light of the Fusion Center effort, focusing on some of its sillier concerns, such as the overwrought government monitoring of an Occupy Movement call for a boycott of the retail industry’s Black Friday sale weekend.

# FBI chasing 2,000 domestic terror cases; antifa aren't among Capitol suspects, Wray says

FBI Director Christopher Wray on Tuesday described an ominous warning the night before the Capitol riots about the prospect of extreme violence as "raw, unverified, uncorroborated information" – but he said the bureau's report was shared extensively with Capitol Police and other authorities.

Wray said the report, which concluded that extremists were "preparing for war," was provided to authorities at the command level, distributed to its local Joint Terrorism Task Force network and posted on a national electronic portal for review by law enforcement authorities across the country.

The FBI director's testimony before a Senate panel comes nearly a week after former U.S. Capitol Police Chief Steven Sund told a separate Senate investigating committee that the intelligence never made it to him and others before the attack that left five dead, including Capitol Police officer Brian Sicknick.

Sund acknowledged that the bulletin landed at the Capitol police agency's intelligence unit but was never forwarded.

FBI director: Warnings about Capitol violence shared with police

FBI Director Christopher Wray said a "raw" warning was shared extensively with Capitol Police the night before the Capitol riots.

Though Wray told lawmakers Tuesday that he did not become aware of the report's existence until "some number of days" after Jan. 6, he said the contents of the advisory were important enough for the FBI to distribute it across law enforcement at the time.

"Because of the level of detail that was in it, the judgment was, given the press of time, given the specificity ... was to push it to the people who needed it," he said.

Pressed by lawmakers on why the information had not been seen by either the former Capitol chief, who resigned shortly after the attack, or the acting District of Columbia police chief, Wray said, "I don't have a good answer."

"It was more than just an email," the director said, adding that at least five Capitol police officers who also serve as members of a Capitol-area terrorism task force would have received it.

In addition to the report's placement on an electronic portal, Wray said, the information was included a "verbal" briefing for law enforcement officials at a local command center.

But Sen. Richard Blumenthal, D-Conn., citing the volume of threat-related information circulating across social media in the days before Jan. 6, suggested that the FBI should have called more urgent attention to the risk.

"Why didn't you sound the alarm in a more visible and ringing way?" Blumenthal asked.

The director said he had warned repeatedly of the mounting domestic threat in recent years and again defended the bureau's handling of the threat report distributed the night before the attack.

## 'Far-right extremists are the most significant domestic terrorism threat'

Wray's testimony comes six months after he offered a now-prescient warning of the threat posed by domestic extremists.

“Trends may shift, but the underlying drivers for domestic violent extremism – such as perceptions of government or law enforcement overreach, sociopolitical conditions, racism, anti-Semitism, Islamophobia, misogyny and reactions to legislative actions – remain constant,” Wray said then.

The director on Tuesday described how the Capitol assault involved some of the very classes of extremists he warned about in September.

Wray said the Capitol extremists represent just part of a burgeoning domestic threat landscape in which agents are working about 2,000 investigations, double the number the FBI reported four years ago.

In opening Tuesday’s hearing, Senate Judiciary Committee Chairman Dick Durbin, D-Ill., declared that the “federal government has failed to address the growing terrorist menace in our own backyard.”

He took sharp aim at the Trump administration, saying officials “spent four years downplaying the threat posed by white supremacists.”

"It was only after Black Lives Matter activists protested last summer against police misconduct that the (Trump) administration found the need to establish a task force to address anti-government extremists,” Durbin said.

“We need to be abundantly clear that white supremacists and other far-right extremists are the most significant domestic terrorism threat facing the United States today,” Durbin said. “I hope that everyone in this room can look at the facts and acknowledge this, and that we can come together on a bipartisan basis to defeat this threat.”

Domestic right-wing extremists were responsible for almost 70% of terrorist attacks and plots in the U.S. in 2020, according to the Center for Strategic and International Studies, a Washington-based think tank.

## In 'massive' Capitol investigation, antifa aren't

Wray's testimony comes as a separate joint committee of the Senate continues its investigation of the Capitol assault and law enforcement's failure to prepare for it and repel the rioters.

Since the attack, the FBI has been leading a far-reaching criminal investigation that has resulted in charges against more than 300 suspects and the arrests of at least 280 others.

Wray acknowledged that followers of the left-leaning ideology known as Antifa – short for "anti-fascist" – and Black Lives Matter are not among the hundreds swept up so far in the ongoing Capitol investigation, dispelling unfounded conspiracy theories advanced by Trump supporters.

On Tuesday, Wray was pressed for an update into the federal investigation into Sicknick's death and conflicting accounts about the cause of his death.

The director said the bureau still was not in a position to determine the exact cause of death.

Under Wray's direction, the bureau has been examining tens of thousands of digital images leading to the identification of suspected rioters while appealing for the public's help to identify suspects who were involved in planting pipe bombs at the headquarters of the Republican and Democratic national committees.

Investigators believe the live explosives were delivered to the sites between 7:30 and 8:30 p.m., the evening before the attack.

In January, the FBI released images of a unidentified suspect dressed in a gray hoodie and carrying a backpack. Prominently featured in the FBI's appeal included the suspect's footwear, described as Nike Air Max Speed Turf shoes in yellow, black and gray.

Citing the "massive" scale of the Capitol investigation and a "metastasizing" overall domestic threat, Wray acknowledged Tuesday that the bureau needed more help.

"We need more agents; we need more analysts," the director said.

## Threats persist

Last week, federal officials said that the threat to the Biden administration persists and that [authorities are "very closely" monitoring the run-up to President Joe Biden's address][9] to a joint session of Congress.

The assessment, provided in a domestic terror briefing, followed a separate warning by acting Capitol Police Chief Yogananda Pittman, who told lawmakers that "militia groups" that took part in the Jan. 6 attack seek to "blow up the Capitol," possibly targeting Biden's address.

In the coming weeks, Biden is expected to give his first formal address to Congress – similar to a State of the Union address. The date of the speech has not yet been scheduled.

At a warehouse in New Jersey, 6,000 used copy machines sit ready to be sold.

CBS reports almost every one of them holds a secret.  

Nearly every digital copier built since 2002 contains a hard drive - like the one on your personal computer - storing an image of every document copied, scanned, or emailed by the machine.

In the process, it's turned an office staple into a digital time-bomb packed with highly-personal or sensitive data.

If you're in the identity theft business it seems this would be a pot of gold.

"The type of information we see on these machines with the social security numbers, birth certificates, bank records, income tax forms," John Juntunen said, "that information would be very valuable."

Juntunen's Sacramento-based company Digital Copier Security developed software called "INFOSWEEP" that can scrub all the data on hard drives. He's been trying to warn people about the potential risk - with no luck.

"Nobody wants to step up and say, 'we see the problem, and we need to solve it,'" Juntunen said.

This past February, CBS News went with Juntunen to a warehouse in New Jersey, one of 25 across the country, to see how hard it would be to buy a used copier loaded with documents. It turns out ... it's pretty easy.

Juntunen picked four machines based on price and the number of pages printed.  In less than two hours his selections were packed and loaded onto a truck. The cost? About $300 each.

Until we unpacked and plugged them in, we had no idea where the copiers came from or what we'd find.  

We didn't even have to wait for the first one to warm up. One of the copiers had documents still on the copier glass, from the Buffalo, N.Y., Police Sex Crimes Division.

It took Juntunen just 30 minutes to pull the hard drives out of the copiers. Then, using a forensic software program available for free on the Internet, he ran a scan - downloading tens of thousands of documents in less than 12 hours.

A leaked document shines new light on a surveillance program developed by the National Security Agency.

The program, known as Ragtime, collects the contents of communications, such as emails and text messages, of foreign nationals under the authority of several US surveillance laws.

Details of the program are held in the highest tiers of secrecy, known as exceptionally controlled information, with only a few NSA staffers having access to the program and its data.

There were four known versions, according to a 2013 book, released just months before the first documents published from the cache of documents leaked by whistleblower Edward Snowden. Ragtime-A is said to involve the US-based collection of foreign-to-foreign counterterrorism data; Ragtime-B collects foreign government data that travels through the US; and Ragtime-C focuses on the nuclear counterproliferation effort.

Another program stands for Ragtime-P, which is said to stand for the Patriot Act, which authorizes the collection of bulk metadata on calls and emails sent over the networks of telecom providers. A leaked court order showed Verizon was ordered to turn over customer call records to the NSA on a daily basis. Dozens of other companies have also been compelled to provide data for Ragtime.
