Sometimes people all about love , light & rainbows use that feigned sweetness to gaslight those with less power, especially Black people. Not only did @LOLSurprise use her likeness without a license, @lisafrank posted a condescending insult to her on their BLM post after copying her interior design 8 months ago!! 😡 Though not 100% copy, power dynamics and previous contact from both make it shady AF! Are you a black artist taken advantage of, or your IP stolen by a white or white owned entity with more power? I might be able to offer some tips or moral support. And I haven’t received any acknowledgment or compensation from them in any way. In fact, they are straight up ignoring me. ⁣⁣⁣Here are the facts:⁣⁣ 1) I wore my hair like this and shared pics on here from 11/18-02/19. ⁣⁣⁣⁣⁣⁣ 2) In April 2019 LOL surprise reached out to me and hired me to be a guest on their YouTube channel for a kids interior design show. ⁣⁣⁣⁣⁣⁣ 3) July of 2019 they released this doll that looks exactly like me. ⁣⁣⁣⁣⁣⁣ 4) I found out about it because I started to receive messages asking if I knew about the doll, and its striking resemblance to me and my unique hair/outfits. ⁣⁣⁣⁣⁣⁣ Having huge corporations make money off my ideas and identity, while I struggle financially as a Black freelance artist has been both infuriating and devastating! ⁣⁣⁣This happened just after I learned I was autistic, and I was still trying to figure out what that even meant. I didn’t really have the space to speak up about the situation publicly, but we absolutely did reach out to #LOLsurprise and their parent company @mgaentertainment via every possible channel that was available to us. Not only did they ignore us, but LOL surprise unfollowed me! *Update 12/26/2019 The dispute has been resolved between Mother Plucker Feathers and I. I'm sick to my stomach right now seeing my Kira design on a Kardashian, and the company taking credit for the creation had come to me in October asking me for materials resources 🤬🤬🤬 I sent him to my tutorial, which specifically even has a statement in the first few minutes about the importance of Copyright and not using other's designs. This design was worn in 2016 by 2 different Victoria's Secret models in the fashion show and seen the world over, one of my more popular designs. He even came to me last year for giant wings also for Kylie, that fell through after I sent him wing frames of a different style - that he wound up not even using for her. This one deserves an IP attorney's involvement and I'm not going to bother arguing with any of them personally about whether or not this is infringement because this is blatant, and this is fucking bullshit. The Swimtails final outcome: I'm still not paid, they wanted me to sign a release THEY were writing up, and, said their IP attorney who they would not identify except as 'Peter' insisted they did not actually violate my IP. I call BS. That would have forced me to pay an attorney to handle some agreement that might have some shadiness in it, which would have cost me a lot more than the fee I requested and made it worthless. F**k no. News flash - the infringer doesn't write up a release contract for the IP holder whose IP they violated. How low can you go? Well, faking a screen shot to deflect blame from your infringement to blame an innocent person is pretty effing low 😡 Her Tumblr name is funny but what happened isn't. This last week, the edgy designer fashion label with the problematic name, @gypsysport posted an image with my fairy wings pasted onto it without my permission, compensation or credit. A follower tagged me in the comments, so I asked them to please remove the photo as my image was not for use. They only offered to tag me and blamed it on a supposed #Barbie photo they said they found on Tumblr. They had my DMCA with proof of my ownership and my copyright registration number, but refused to take it down until 24 hours went by and the image gathered nearly 4,000 likes. Too late. I repeatedly asked for the original photo or a link, but all I got was a crappy screen shot of some Tumblr search results that cropped out the URL & other important info. I could make out the Tumblr name though and found the artist, Ivonne, who is an art student in Puerto Rico. They replaced her illustration with their doctored image in a faked screen shot! Her home was wrecked in the hurricane and she's currently not able to live in it, yet Gypsy Sport was okay with framing this innocent person to make it look like she stole my photo first. This is not okay. Especially not for a company that claims to stand for equality and civil rights 😑 They even put some blame on @mattel too! I hate art thieves. I hate them lying about it even more, but blaming innocent parties is horrid, especially when that person is going through what Ivonne is going through. It would be really nice of Gypsy Sport to offer a sincere apology and donate to Ivonne, who needs to raise funds to rebuild her family's home. PSA: you will only find my products listed in my Etsy shop (etsy.com/shop/idolatre), or on my personal website (idolatre.com). If you see my images selling products anywhere else online, IT’S A SCAM. I woke up this morning to an email from a customer alerting me to this Chinese knockoff site which has stolen my images, removed the watermarks, copied my listing text, and is now “selling” my products. When I reached out to them via email, my message was blocked. This company looks as if most of its images are stolen from other independents selling their handmade works, and is currently advertising heavily on Facebook, blocking anyone who comments that the work is stolen. No doubt if you purchase anything from their page what you receive will NOT be the item you were expecting, if you receive anything at all. This is so frustrating for me as an artist, a business person, and someone who genuinely cares about their customers.
