The ELON MUSK Act
On Wednesday 2025-02-05, Mark Pocan (D-WI-2) introduced the Eliminate Looting of Our Nation by Mitigating Unethical State Kleptocracy Act aka the ELON MUSK Act.
His announcement.
It specifically prohibits Special Government Employees from also operating as government contractors, closing a loophole in regulations that keep Congress members and other federal employees from receiving government contracts.
if passed, it leaves Elon with the choice to get out of government or to lose many billions of dollars. His whole career is built on government subsidies and contracts.

The president has no qualms about criticism for mixing state and personal business.
Next year the United States will be hosting the 2020 G7 economic summit.
Trumpâs profits from the Trump National Doral luxury golf resort in Miami, Florida have fallen 69% in the past two years. (According to Trumpâs own tax consultant, the losses are the result of âsome negative connotation that is associated with the brand.â In other words, the Trump name has been hurting Trumpâs businesses.)
What do these two things have to do with each other?
âTrump has bigger designs for the Doral club: He has suggested holding next yearâs Group of Seven meeting â a gathering of world leaders â at Doral or another of his luxury resorts.â
Problem solved!
The Trump Organization did indeed submit a bid to host the 2020 G7 summit at the Trump National Doral. The Trump administration has now formally selected Trumpâs resort as one of the few official finalists. Trumpâs latest gambit to add to the $1.6+ million he has already reaped in profits from his presidency--not to mention the $1.5+ million in campaign donations heâs paid to himself--appears to be going swimmingly.
A judge said lawmakers could begin seeking financial information and other records from the Trump Organization this week.
The United States Constitution forbids the President from accepting anything of value--called an âEmolumentâ--without the consent of Congress. Trump is infamous for his complete disregard of this constitutional provision (along with so many other provisions), and the Trump Organization has continued raking in hundreds of millions of dollars and other benefits from foreign governments.
At least two federal lawsuits are currently challenging Trumpâs utter disregard for the Constitution he swore to uphold. Trump has consistently tried to get the lawsuits thrown out of court, and he has failed just as consistently:
âThe President is subject to both Emoluments Clauses of the Constitution and that the term âemolumentâ in both clauses extends to any profit, gain or advantage.â
Trumpâs primary concern is to keep anyone from ever seeing any of his financial information. Heâs been defying Congressional subpoenas (and losing in court), and heâs taken the same approach with these lawsuits. His latest gambit was to ask the courts to stay both lawsuits while he appealed the denials of his demands for dismissal. If successful, the stays would have prevented all discovery for months if not years.
Both courts rejected Trumpâs demand. Both lawsuits are going forward. And Trump and his business interests are subject to the ordinary discovery process in both of them. Which Trump will, of course, continue to stonewall at every conceivable opportunity.
