Richard Luthmann Releases Statement in Support of Cathy Guerriero For Public Advocate

She’s a fighter running for Public Advocate, and we need her.

Cathy comes from working class, Staten Island roots.  Her mom taught and her dad worked two full-time jobs, as a teacher and a longshoremen security guard to support the family.  She attended Wagner College and then worked for Catholic Charities, so she knows the issues we face.  She won’t back down from challenging the powers that be, because that’s just who she is – passionate about the issues and ready to stand up for you.

She’s an education professor at Columbia and knows how important it is to fight for parents’ voices in our children’s schools.  And as a Staten Island native, she will fight against those painful Verrazano Bridge toll hikes, which are especially hurting our small businesses.

Staten Island Borough Presidential Candidate Richard A. Luthmann Set to Bring His Case To New York's Highest Court

Luthmann Will Seek To Defend the Rights of Disenfranchised Staten Island Voters On Wednesday, August 21, before the New York State Court of Appeals in Albany

Staten Island, N.Y. – While the State Appellate Court ruled against Richard Luthmann’s bid to be re-instated on the ballot for the Democratic Primary for Staten Island Borough President, the man who created his own grassroots campaign says the fight is not over.

Luthmann is prepared to present his case before New York State Court of Appeals on August 21. Luthmann has sent a letter to the Court asking for a Writ of Certiorari,  which will allow him to present an oral argument to the Seven Justices of New York’s High Court.

“One way or another, the people’s advocate will finish what we started on the Courthouse steps of New York’s High Court next week,” said Luthmann.  He said he started his campaign to get more Staten Islanders involved in the election and in local politics and expand the base of the Democratic Party, which he believes he has accomplished. He says the fight is not just for him but to challenge entrenched party politicians and to open the process up for the next generation of voters and elected officials.

Luthmann says his campaign was about more than court fights and collecting signatures.

“I am happy to have engaged in the process,” Luthmann said.  “I am happy to have heard many new ideas, meet great people and I am happy to have raised awareness as to some of the faults in the existing local political machine. We raised some very important issues about stifling City fees and taxes, the Island’s antiquated infrastructure and the green energy and environmental potential that we have not fully explored.  Most of all, I am happy to have blazed the way for young, grassroots campaigns to spring up.”

Luthmann also said he will remain active in politics.

“We have built a great machine of strong Democrats and we have expanded our party’s base.  We will continue to work to get Democrats like Bill Thompson and Debi Rose into office.  I also look forward to helping rising stars from our Island likeCathy Guerriero, John Mancuso and others, win their respective races in September and November.”

Luthmann thanked his great team of loyal volunteers who have helped to propel the campaign to this point.  “So many helped, but there were a few all-stars that I must thank personally for sacrificing so much personally, professionally and politically by taking a chance on me.  I would like to thank each of them from the bottom of my heart.  They know who they are, and no matter what happens, each of them will be getting a phone call on Wednesday.”

Staten Island Borough Presidential Candidate Richard A. Luthmann will make his case before the New York State Supreme Court Appellate Division in Brooklyn to have his named restored to the Democratic Primary Ballot.

“We have advanced arguments under the New York State Constitution and the Election law.  We believe that over 400 Staten Island voters were disenfranchised by arbitrary and capricious actions of the Board of Elections, and the Supreme Court and we will fight for them,” Luthmann said.

Never Give Up! Luthmann Closes In On Restoration To The Ballot

Staten Island Borough Presidential Candidate Richard A. Luthmann Says He Will Not Quit.

Staten Island Borough Presidential Candidate Richard A. Luthmann continues to press his case before the New York State Supreme Court to have his named restored to the Democratic Primary Ballot.

“We are gaining momentum and getting closer to having the officials recognize that magic 2,000 number.  At last count we are over 1,900 confirmed signatures and we still have a large number of signatures to go.  I’m confident we’ll get there,” Luthmann said.

If the Supreme Court action is not successful, Luthmann has a chance to go to the Appellate Division, Second Department in Brooklyn to press his case.  But no matter what happens, disenfranchised voters who signed Luthmann’s petition have a right to go to Federal Court for redress and seek damages.

Luthmann thanked his great team of loyal volunteers who have helped to propel the campaign to this point.

“I know that I have rocked the boat and challenged the political establishment of my own party.  People who I thought were friends have distanced themselves.  But we will press on because the People deserve someone fighting for them and confronting real issues that face our community,” Luthmann said.

He continued, “Yesterday, I was in search of inspiration, and I watched one of the most inspiring oratories in recent memory.  Coach Jim Valvano’s famous speech makes clear that no matter the odds, we all have to fight and we have to live each day to its fullest.  And that is my promise to all who support me – I will do just that.”

Luthmann Presses Case in Court on Voter Signatures

At a Friday hearing, Luthmann presents his case for getting on the Democratic Borough President’s primary ballot.

Staten Island, NY – Richard Luthmann, who is challenging for a spot on the Democratic primary for the Borough President’s race, will appear in court today to present his case should he fall short of the necessary amount of signatures to validate his campaign.

A candidate must file at least 2,000 valid signatures from Democratic voters to be included in the primary election. So far the Luthmann campaign has filed more than 3,000 signatures but they have been challenged. This is a standard practice as signatures collected on the street can be rejected for several reasons, such as not valid home address or the signer is not a registered voter.

“We have more than enough signatures and I am confident that ultimately we will be on the primary ballot,” said Luthmann. “Despite challenges, we expect to exceed the 2,000 required and are looking forward to a primary campaign. This is simply a – ‘just in case legal filing.’ ”

The suit brought today before State Supreme Court Justice John A. Fusco, is simply a preventative measure should the number of accepted signatures fall short and the campaign needs to challenge the ruling that rejects the signatures.

Today’s court appearance is the second on this issue.

“I deeply regret confusion on my part that caused the hearing earlier this week to go less than smoothly,” Luthmann said. “As an officer of the court myself, I have nothing but respect for the judge and the process and I look forward to settling this issue and moving on to take my message to the voters.”

“There have been a few issues that have concerned my campaign in the past few weeks and my purpose in this campaign is to offer a fresh face and voice for Staten Island Democrats,” Luthmann said. “Campaigns are fluid things that rarely run in a straight line and I look forward to dealing with the real issues as they come up. I want to be the Borough President for not just all Democrats but all Staten Islanders. Naturally I support all the Democratic candidates in all races and I look forward to joining with the party and help create a landslide election for all Democrats in 2013.”

“Our borough has for the past many years seen a Republican stranglehold on not just elected offices but appointed ones as well,” Luthmann said. “While I am sure that fairness is the standard we all want, I hope and expect I will have a fair opportunity to run for office so I can do my best for the people of Staten Island. My campaign is about fixing transportation problems, helping seniors get proper medical care and making sure that Staten Island is the most environmentally aware borough in New York City. That’s what my campaign is about.”

Staten Island Borough Presidential Candidate Richard A. Luthmann says his campaign is a referendum on short-sighted political leadership.

“Atlantic Hurricane Season began on June 1.  We have experienced record-high temperatures and the kinetic energy in the oceans is welling up.  Our political leaders have done little to protect us from  Mother Nature.  In the Rockaways and in Coney Island, steel reinforced sea-walls are being built and installed right now.  But on Staten Island, we are getting SAND-BAGGED - literally, figuratively and politically,” Luthmann said.

Luthmann called for an immediate release of discretionary funds controlled by the Borough President and the Mid-Island Councilman in order to implement substantial protective measures to protect Staten Island and its property owners.  Luthmann believes that significant fault lies with elected officials who have long known of the problems and have not taken reasonable steps to ensure shoreline protection.

“We have known that Midland Beach and Oakwood Beach and Cedar Grove have had terrible flooding events.  Development continued.  We have known that we were a tidal wave away from disaster.  And yet little was done,”  Luthmann told NY1 in arecent interview.
