Listen, I want to be optimistic. I want to believe the Transgender Amendment Bill 2026, if passed into an Act, will not hold up in the Supreme Court because it is in clear and direct violation of the 2014 NALSA judgement guaranteeing the right to self identification as a necessity to a right to live with dignity as stated in Article 21.
But... this is the same Supreme Court that upheld the ban on blood donation on homosexuals because "we can't even take the 1% chance of HIV transmission" while ignoring the processes in place that screens for HIV and other blood borne diseases to prevent exactly transmissions like these. Equality before law and right to be protected against discrimination is guaranteed under Article 14 and 15. Did this judgment care about the equality and protection against discrimination guaranteed under the Constitution? It's a blatant violation of both the articles and they just didn't care.
So even though I know this Bill doesn't hold up against NALSA and Article 21, you know this Bill doesn't hold up against NALSA and Article 21, do the judges do? And if they do.... do they even care???
