Reuters reports today that Israel plans to reject the investigative efforts of the International Criminal Court concerning the body’s plans to establish whether war crimes were committed by the Israeli government and/or Hamas in the West Bank/Gaza Strip. The article notes that Israel was not a signatory of the statute establishing the jurisdiction of the ICC and is therefore not party to the obligations which bind signatories. Regardless of the outcome of the ICC’s planned investigation I have serious doubts that anything of substance will result from such an effort. The ICC has historically proven itself to be a generally toothless organization whose enforcement capabilities are constrained by its effective inability to prosecute non-participants. The last major international criminal trial wherein nationals of a geopolitically significant state were held to account for ‘war crimes’ was at Nuremberg, 75 years ago. Even then, the nations who prosecuted and passed judgment at Nuremberg were far from blameless insofar as violations of international conventions of conflict were concerned, especially the USSR. Application of international law will probably always be marred by the stain of accusations of ‘hypocrisy’ or ‘victors’ justice’, though this doesn’t necessarily preclude the necessity of international rules governing inter-and-intra-state conflict. I think there is definitely something to be said for the critique that international conventions of ‘human rights’ are an inherently subjective concept, but the same critique can be leveraged against any kind of law or rule. The fact that the United States, whose representatives fashion themselves often as arbiters of justice international arena, is especially reticent about subjecting its citizens to the auspices of the ICC and similar judicial bodies, is to my mind the single largest impediment to those bodies’ legitimacy. Those international bodies in which the US participates are usually those which end up having the strongest enforcement capabilities.
