Flight From Police
This charge applies when a driver, in an attempt to evade a peace officer, does not stop their vehicle as soon as it is reasonable to do so.
The penalties can be severe. If prosecuted by summary conviction, a person may face a fine of up to $5,000 and/or up to six months in jail. If the charge proceeds by indictment, the maximum penalty increases to up to five years of imprisonment. There is also an automatic driver’s licence suspension of at least one year under the Highway Traffic Act.
Additional consequences may include a court-ordered driving prohibition, probation, a criminal record, and increased insurance rates.
