Click here for more background on HB1781, a bill to stop the Texas Department of Agriculture (TDA) from imposing fines on Texas schools for selling junk food.
The bill, which was meant to buck state nutrition policies, is nevertheless sloppily written. As such, it is in direct conflict with the Healthy Hunger-Free Kids Act (2010), parts of which amend Section 10 of the Child Nutrition Act of 1966 (42 U.S.C. §1779) to regulate the number of junk food fundraisers schools are allowed to host. These regulations are set to go into effect next year.
Come 2014, the TDA will have to make the tough choice: follow federal regulations violating HB1781 or follow HB1781 in violation of federal law.
