The events in this video took place in Pennsylvania.

  If this had occurred in New Jersey, the individual involved in the physical altercation could expect to be charged with aggravated assault.

  The degree of aggravated assault involving a police officer depends on the injury to the victim. If the victim suffers bodily injury, defined below, it is a third degree crime, otherwise it is a fourth degree crime. N.J.S.A. 2C:12-1(b)(11).

  Third degree crimes carry a sentencing exposure of three years to five years New Jersey State Prison. Fourth degree crimes carry a sentencing exposure up to 18 months New Jersey State Prison. N.J.S.A. 2C:43-6(a).

  A person is guilty of aggravated assault under New Jersey law if he commits a simple assault, defined below, upon any law enforcement officer acting in the performance of his duties while in uniform or exhibiting evidence of his authority or because of his status as a law enforcement officer. N.J.S.A. 2C:12-1(b)(5)(a).

  Simple assault under NJ law applies if a person:

Attempts to cause or purposely, knowingly or recklessly causes bodily injury to another; or

Negligently causes bodily injury to another with a deadly weapon; or

Attempts by physical menace to put another in fear of imminent serious bodily injury.

N.J.S.A. 2C:12-1(a).

Bodily injury means physical pain, illness or any impairment of physical condition. N.J.S.A. 2C:11-1(a).

Serious bodily injury means bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement, or protracted loss or impairment of the function of any bodily member or organ.N.J.S.A. 2C:11-1(b).
