⭐️🇺🇸 Section 230 and Meta in the news! 🇺🇸⭐️
So first of all, I want to remind you all what Section 230 does because it is VERY important we have it!
Section 230 protects websites and online services from being legally responsible for content posted by their users. It allows everything from major social media platforms, small forums, blogs, etc. to host user speech without being liable for every piece of content someone posts.
What happened to Meta in this case?
Basically Meta asked a lower court to dismiss lawsuits claiming its social media features contribute to addiction. Meta argued that some of the claims were really about how it publishes and distributes users' content (which Section 230 protects). The lower court rejected Section 230 protection for some of those claims they made. Then Meta tried to appeal immediately after that. Then it went to the Ninth Circuit and they ended up saying no. It was because the lower court's decision didn't end the case, Meta generally has to let the lawsuit continue before trying to get an appeal.

District Court/lower courts ruled against Meta's Section 230 argument on some claims.
Ninth Circuit or Courts of Appeals reviewed whether Meta could immediately appeal.
After this it MIGHT potentially go to
The Supreme Court. They could potentially review the Ninth Circuit's decision if it agrees to hear the case. (SO we will see on that!)
The cost of defending a lawsuit itself could pressure websites into censoring free speech, even if they would win under Section 230. If this happens it might cause smaller websites to be harmed especially because they can not afford a lengthy court process. So they might just start censoring free speech instead of fighting a case. This is a pretty bad outlook for other/future court cases that will eventually happen to other platforms 😔.
