In a case involving alleged real estate agent service, CESTAT Delhi has rejected department’s plea that since the land sold was not in the name of assessee, it was not a transaction for sale or purchase of land.

 It held that for a principal to principal transaction for purchase and sale of land, it is immaterial whether the property sold is in the name of the seller or in the name of some 3rd party. Observing that assessee did not act as agent and was into buying/selling on a principal to principal basis, the Tribunal in the case of Premium Real Estate Developers v. Commissioner held that assessee was not engaged in real estate agent service. 

It also held that in the absence of any defined consideration for alleged services there was no contract of service at all and hence no liability. 

As an agent I ALWAYS have the customer in mind.  Honesty is a vital part of our agency because if you lose trust in us we know you take your business to another company.  Our job is to help our customer and do the best job we can for them.  We rely on giving good customer service because we want you to remain with our agency.  An agent has a vested interest in the customer because if we lose you, we lose income. 

The premiums you pay are no different if you have your policy directly with the company as opposed to having a local agent.    Employees that work at a Direct Writer company get their 8 hours in and go home and it does not really matter as much if you leave and go to another company.  On the whole you will (should) get better service from a local agent than a policy written through a Direct Writer.  Some examples of Direct Writers are Progressive, GEICO and Safe Auto.  Even at Nationwide, they have an option available to write your policy and keep the business in house if you do not want an agent.  But again, I feel we offer a valuable service to our customers.
