Like I need people to understand the mental image here of a multimillionaire internet creator personally overseeing DVD production in his own house like he’s running an underground bootleg operation out of a basement in 2007.

It’s weirdly charming because there’s something very “old internet” about it, this energy of “I made a thing, and now I will physically hand it to people myself like an artisan at a craft fair.”

I’m using your comment as an example here because I’ve seen this question come up elsewhere and have also been asked about it in the tags.

No. Piracy is the duplication, downloading, or distribution of media you do not own the rights to without permission from the rights holder. So someone making copies of a movie they made and own the rights to with a disc burner would not count as piracy.

That’s just… distributing your own work.

It’s fundamentally not that different from an indie musician handing someone a burned demo CD, or a game developer passing around early builds of a game they made themselves. The whole issue with piracy is the lack of permission and ownership involved. If you are the creator or rights holder, then you are the person granting permission in the first place.

Now, hypothetically, if he had sold the movie to a studio and part of that contract included handing over distribution rights, and then he started independently burning and selling copies anyway without permission, THEN yes, that would likely fall into piracy or copyright infringement territory.

But as far as he’s publicly said, that does not appear to be the situation here. It sounds like he still retains the rights to distribute the film himself, which means he’s fully within his rights to do weird little DIY physical releases out of his house like a cryptid Criterion Collection employee.

Now, there IS still usually a whole separate layer of rights clearance involved behind the scenes for things like music, stock assets, sound effects, visuals, union agreements, and so on, because licensing for a theatrical release is not always identical to licensing for home release or private sales. Sometimes those agreements have separate clauses, additional permissions, regional restrictions, expiration dates, all sorts of deeply unsexy legal paperwork labyrinths.
