Under Texas law, a suspended or revoked license may be reinstated for specific, essential uses. If the individual can prove the need to drive for employment, caretaking, or education-related purposes, they may petition the court for an occupational driver’s license (ODL). The ODL can only be used for driving a non-commercial vehicle. Some charges bar the individual from receiving an ODL. For example, individuals with license suspensions or revocations due to past-due child support or certain driving while intoxicated charges cannot qualify for an ODL. Additionally, the need for the license is determined by the judge who will consider if the individual poses a threat to public safety.
