A nearly 100-year-old Ohio family farm won its zoning case, then the county voted to keep suing them anyway.

The Garver Family Farm in Butler County has farmed the same land for nearly a century. They built a new market building to sell their produce, wine, and farm products.

Butler County zoning officials claimed the building was too commercial because it included a deli, bakery, and coffee shop, and issued a violation.

The family appealed. In March 2026 the Butler County Board of Zoning Appeals sided with them 4-1 and ruled the operation could keep its agricultural designation.

The county then appealed that decision to Common Pleas Court. In late July commissioners voted 2-1 to continue the legal fight.

The real driver appears to be money. Reclassifying the property as primarily commercial would strip the preferential Current Agricultural Use Value tax rate and raise the family’s property taxes on the building and land.

Owner Michael Garver has said the higher costs could put the multi-generational operation under.

A family farm that grows food and makes its own wine is being forced to keep spending money in court after already winning once.
