Lord Grabiner advances this argument with some force. He says that any other view is heresy and that he is incontrovertibly correct. Indeed he goes as far as to say that he is prepared to go to the stake on this point. One cannot but be impressed by this level of selfless dedication to his client's cause. I am not sure whether he expects the rest of the Abbott legal team to join him on the pyre, but, a single raised eyebrow from Mr Thorley suggests that he, at least, is not going to volunteer. I hope Lord Grabiner can be persuaded to think again, otherwise it would be the end of what has the signs of being a promising career. In spite of Lord Grabiner's threat of self immolation, or perhaps encouraged by it, Mr Vos relies on numerous authorities and references in Snell and Spry to show that Lord Grabiner's view of the law is wrong.

In this they have the support of a very distinguished Court of Appeal in New South Wales, in Flaherty v Girgis (1985) 63 ALR 466, where Kirby P and Samuels JA agreed with McHugh JA.

I have no hesitation in concluding that I should strike out the applicant's claim, as I do. It is a farrago of delusional nonsense.

By way of postscript, the Board records a contention that, even in the event that its construction of the statutory condition was to prove adverse to the company, it should allow the appeal on the ground that, by its decision in the letter dated 16 September 2011, the authority had acted unfairly towards it. Under this rubric Mrs Boolell brings a scattergun approach to the task of advocacy. She contends that the decision had been irrational; that it had been brutal; that it had been in breach of the rules of natural justice; that it had been unexplained; that there had been no level playing-field; that the authority had misused its power; that it should have sought clarification of Mr Mooroogan’s breakdown of the figures; that it had had a discretion when deciding whether the condition had been satisfied; that in this respect it should have been guided by Mr Mooroogan and any quantity surveyor instructed by itself; that it had failed to act transparently; that its decision had frustrated the purpose behind the 2009 Act; and that it had defeated a legitimate expectation on the part of the company that it would be taken to have satisfied the condition. The trouble is that there was no arguable foundation for any of these contentions.
