🚨 Musk’s X Sues Former Senior Engineer Over Alleged Theft of Source Code

A major conflict is unfolding inside the tech world. X Corp has filed a lawsuit against former senior engineer Yao Yue, accusing her of stealing millions of lines of proprietary source code to build a rival startup, IOP Systems.

According to the federal complaint filed in San Francisco, Yue allegedly copied internal tools and confidential performance-optimization code shortly after Elon Musk acquired the platform in 2022. X Corp argues that this technology forms the backbone of IOP’s performance-monitoring products—tools that closely resemble those she spent more than a decade developing at the company.

Yue, who was dismissed in late 2022 after speaking out against internal policy changes, is accused of “orchestrating” her own departure to raise her profile. X is now asking the court to stop the alleged misuse of its trade secrets and seeking monetary damages.

IBM Prevails in UK Lawsuit Against LzLabs Over Alleged Mainframe Technology Misuse

LzLabs and Moores contested the lawsuit, asserting that LzLabs had independently developed its software over nearly a decade and had not unlawfully utilized IBM's licensed technology.

However, the UK High Court largely sided with IBM, with Judge Finola O'Farrell stating in a written judgment that Winsopia had violated the terms of its IBM software license. She further noted that "LzLabs and Mr. Moores unlawfully procured (those) breaches."

An IBM spokesperson expressed satisfaction with the ruling, emphasizing that the technology in question "represents billions of dollars of IBM investment."

The ruling, issued on Monday, followed a trial last year that sought to establish the defendants' liability to IBM. A separate hearing will be held later to assess potential damages.

Meanwhile, IBM’s claims against another UK-based subsidiary, LzLabs Limited, as well as the company’s current and former CEOs, were dismissed.

LzLabs has not yet provided a response to requests for comment, and Moores could not be immediately reached.

🎯 Oracle sues payment software company Procore over trade secrets

On October 28, Oracle, the major software company, filed a lawsuit against Procore Technologies, a provider of software for the construction industry, in a federal court in California. The suit accuses Procore of misappropriating confidential information to advance its business. According to Oracle’s claims, former Oracle employee Mark Mariano allegedly took "thousands" of trade secrets with him when he joined Procore, aiding the development of a competing software platform for managing construction payments.

Representatives for Procore, along with Oracle’s attorneys and spokespeople, did not immediately respond to requests for comment on Monday regarding the complaint. Efforts to reach Mariano for comment were also unsuccessful. Oracle, headquartered in Austin, Texas, stated that Mariano previously worked at Textura Payment Management, a construction invoicing and payment services company acquired by Oracle in 2016. The lawsuit claims that Mariano led a team at Oracle responsible for integrating third-party software with Oracle’s payment management platform.

The complaint states that Procore, headquartered in Carpinteria, California, recruited Mariano from Oracle in 2021. Oracle alleges that Mariano brought with him thousands of its files, including source code, customer data, and strategic research plans, which reportedly helped the "struggling" Procore reshape its business. According to Oracle, "soon after Mariano joined Procore with Oracle's confidential documents," Procore launched its own competing platform and swiftly introduced integrations similar to those that Oracle had previously developed while Mariano was involved in those projects.

🎯 Apple Wins $250 US Jury Verdict in Patent Case Over Masimo Smartwatches

On Friday, a federal jury sided with Apple, finding that earlier versions of Masimo's smartwatches infringed on two of Apple’s design patents, as part of an ongoing intellectual property dispute between the two companies.

The jury in Delaware agreed that Masimo's previous W1 and Freedom watch models, along with their chargers, willfully violated Apple’s smartwatch design patents.

Despite Apple’s market valuation of roughly $3.5 trillion, the jury awarded the company just $250 in damages—the statutory minimum for patent infringement in the U.S.

Apple's attorneys emphasized that the lawsuit’s main goal was not monetary compensation but securing an injunction to halt sales of Masimo’s smartwatches following the infringement finding.

However, the jury also concluded that Masimo’s current watch models do not infringe on Apple patents related to the inventions Apple alleged were copied.

Masimo expressed appreciation for the jury's verdict, stating it favored Masimo "on nearly all issues" and clarified that the decision applied only to "a discontinued module and charger."

"Apple primarily sought an injunction against Masimo's current products, and the jury's verdict is a victory for Masimo on that issue," the company added.

Apple, in response, said it was "glad the jury's decision today will protect the innovations we advance on behalf of our customers."

Masimo, based in Irvine, California, previously accused Apple of poaching its employees and misappropriating its pulse oximetry technology after the two companies discussed a potential collaboration.

Last year, Masimo persuaded the U.S. International Trade Commission to block imports of Apple’s Series 9 and Ultra 2 smartwatches after the commission determined their blood oxygen monitoring technology infringed Masimo’s patents.
