A judge has temporarily stopped the Pinal County Attorney's Office from enforcing its agreement with ICE.
FLORENCE, AZ (AZFamily) — A county judge issued a restraining order Monday to stop Pinal County Attorney Brad Miller’s 287(g) agreement with the Department of Homeland Security and Immigration and Customs Enforcement, just a day after the Pinal County Board of Supervisors filed a lawsuit against him.
Pinal County Superior Court Judge Joseph Georgini’s order temporarily blocks Miller’s office from implementing or enforcing the 287(g) agreement and sets a hearing for Feb. 25 at 9 a.m.
Board members contend that Miller entered the agreement without their approval and that only the county sheriff is authorized to approve such deals. They also said only the county sheriff, not the county attorney, has the power to make arrests under the 287(g) agreement, which lets local law enforcement act as immigration officers.
The Board of Supervisors also voted to void Miller’s 287(g) agreement on Jan. 30. Despite this, Miller said he is refusing to end his 287(g) partnership with ICE, saying the deal targets criminal offenders.
