Supreme Court tells lower court to reconsider denying Kirtsaeng legal fees

The Supreme Court has produced an interesting post-script to the landmark Kirtsaeng v. Wiley case, in which it had previously ruled permitted importation and resale of less-expensive textbooks from other parts of the world. Kirtsaeng had prevailed in that case, but lower courts declined to award Kirtsaeng’s lawyers the $2 million in attorney fees they requested.

Australian government: Local books cost too much; why not let stores import them?

The Melbourne Herald Sun has a brief storyon an Australian government report suggesting that books cost too much Down Under and recommending lifting parallel import restrictions. The U.S. Supreme Court recently announced its long-anticipated decision in Kirtsaeng v. John Wiley & Sons, Inc., No. 11-697 (Mar. 19, 2013). The Court decided that the “first sale doctrine” of the Copyright Act applies to goods made abroad.

A post for the Disruptive Competition Project blog on a growing problem with how we regulate intellectual-property: The work of interpreting the law has somehow been grabbed by the people who negotiate trade agreements. And it took a dissenting opinion from a Supreme Court justice (who doesn't seem to see this as a problem!) to get me to realize this.
