Birth right citizenship being protected on constitutional grounds is SO IMPORTANT. This means that the executive order violates the constitution and not just a federal law. Federal laws can be overturned and rewritten or a new one can be passed overruling old ones. The US constitution must be amended and the amendment process is incredibly difficult and there is no world in which an amendment would pass overruling the fourteenth.
Thank GOD birth right citizenship was protected and while it absolutely should have been unanimous, I am not shocked that Alito and Thomas dissented. I am slightly shocked Gorsuch did though.
UPDATE: now that I read more of the dissent, I am not shocked Gorsuch did. His entire thing is Native American law and tribal sovereignty and all that and he tied that into his dissent. I’m still disgusted, but I’m not surprised anymore. I understand why, in his twisted mind, he went there.
Never in my life did I expect to hear a government organization propose a game show for citizenship. We really are in a dystopian hell.
