On Oct. 25, 2023, a little more than two weeks after the Hamas-led terrorist attacks in southern Israel on Oct. 7, anti-Israel protesters screamed āfree Palestineā and pounded on a door at a Cooper Union library, as Jewish students, including two wearingĀ kippahs,Ā hid within. (JNS sought comment from Cooper Union.)
The private school blamed the Jewish students for gathering āin a prominent place in the library where they could be seen by the demonstratorsā and for refusing a recommendation to hide āin the windowless upstairs portion of the library out of the demonstratorsā sight,ā per the judgeās decision.
Cooper Union also faulted them for not escaping āthe library through the back exit,ā he added.
āThese events took place in 2023ānot 1943āand Title VI places responsibility on colleges and universities to protect their Jewish students from harassment, not on those students to hide themselves away in a proverbial attic or attempt to escape from a place they have a right to be,ā the judge said.
āIn sum, the physically threatening or humiliating conduct that the complaint alleges Jewish students in the library experienced āis entirely outside the ambit of the free speech clauseāā and āwas objectively severe,ā the judge wrote.
āThe court is dismayed by Cooper Unionās suggestion that the Jewish students should have hidden upstairs or left the building, or that locking the library doors was enough to discharge its obligations under Title VI,ā the judge added.
āThe judge was not impressed at Cooper Unionās āwhy couldnāt the Jews just hide in the attic?ā argument,āĀ wroteĀ Jason Bedrick, a Heritage Foundation research fellow.
āThe audacity of a university to tell Jewish kids to pound sand as they indulge Islamists and their soft terror tactics on campus,āĀ wroteĀ Marina Medvin, a criminal defense lawyer in Arlington, Va. āThe judge who got the case was appalled.ā

This Day in History: Abraham Lincoln's Cooper Union Speech
On this day in 1860, Abraham Lincoln gives a speech that would propel him toward the presidency. He wasnāt yet the well-known figure that we think of today. To the contrary, his New York audience was being introduced to him for the first time.
They knew him only as the Illinois lawyer who had engaged in a series of debates with Senator Stephen A. Douglas two years earlier.
āNo man ever made such an impression on his first appearance to a New York audience,ā the New York Tribune soon concluded.
