Why do you say that he "could obviously breathe"? He didn't look like he could breathe, and the independent autopsy showed that he died of asphyxiation.
Asphyxiation doesn’t mean you can’t breathe. You can cut off the carotid artery and reduce blood flow (and thus oxygen) to the brain yet still be able to breathe. Both autopsy reports state this, actually, one just says that he died from heart failure due to the stress and position he was in, and the other says he died from the position he was in due to his carotid artery being cut off. It doesn’t seem to matter which autopsy you go with on it, the encounter resulted in Floyd’s death, despite the fact he could breathe.
Even if the cops didn’t intend to kill him, their actions resulted in death, and I’m saying this looking at it from a legal standpoint on how the defense is going to progress. They’ll probably go with a lesser charge than say Murder 1 or 2 because those are a lot harder to get and the chances of the cops walking away are much higher. They want them in jail, so they’ll probably go with Murder 3 (manslaughter) to ensure the cops get put away.
